DEPOSITION - PHONE

Telephone Deposition:  The same as a regular deposition except that the attorneys may "appear" by telephone.  In the alternative, a witness may "appear" by telephone.  If a witness appears by telephone, a notary public must be in the physical presence of the witness to swear the witness in to tell the truth.  The notary public must then provide to the court reporter a certificate stating the said notary public was in the presence of the witness and the notary swore the witness in to tell the truth.  The certificate must then be forwarded to the court reporter for inclusion in the transcript as part of the record
